Determining Eligibility for Bankruptcy Filing

The Means Test is used to determine eligibility for Chapter 7 by determining whether your income meets or exceeds the average income for your state. If your income is below the median average, automatic approved for a Chapter 7 bankruptcy is likely if you choose to proceed with your bankruptcy filing. If your income is above the median average, additional financial inquiries will be made to determine your eligibility. If you are not approved for a Chapter 7, a Chapter 13 bankruptcy debt consolidation filing may better suit your situation.
